This email communique is to provide you with an update on the College’s implementation status regarding the Equal Pay for Equal Work (EPEW) aspect of the ‘Fair Workplaces, Better Jobs Act, 2017’. This EPEW aspect of Bill 148 is scheduled to come into effect on April 1, 2018.
The intent of the EPEW aspect of Bill 148 is to ensure employees who are performing substantially the same job, regardless of employment status (e.g. full-time; part-time; seasonal) receive the same rate of pay. Within the Act, ‘substantially the same’ means work that requires the same skill, effort, responsibility and is performed under similar working conditions in the same establishment.
Exceptions are permitted under the Act in the following circumstances, even if the work being performed is substantially similar to a comparator role:
- A seniority system;
- A merit system;
- A system that measures earnings by quantity or quality of production;
- Any difference that is not based upon sex or employment status.
The College’s regular compensation practice has always been to pay part-time Administrators off the same grid as full-time Administrators. Part-time Administrators are simply paid using the equivalent hourly rate for a respective annual salary amount. This practice meets with the compliance requirements of Bill 148, therefore, no rate adjustments related to Equal Pay for Equal Work are required.
