ACKNOWLEDGEMENT

The Fair Workplaces Better Jobs Act, 2017 (Bill 148) features an ‘equal pay for equal work’ provision.   The intent is to ensure employees who are performing substantially the same* work, regardless of employment status (e.g. male/female; full-time; part-time; seasonal), receive the same rate of pay.    Under the Act, even if substantially the same work is being performed, different pay rates are permitted under the following circumstances:

  • A Seniority System (e.g. an employee with greater seniority than another employee may be paid more)
  • A Merit System (e.g. an employee may be paid more if the pay is based on a system that objectively measures merit)
  • A System That Measures Earnings By Quantity or Quality of Production
  • Any Difference That is Not Based on Sex or Employment Status

* Within the Act, ‘substantially the same’ means work that requires the same skill, effort, and responsibility and is performed under similar working conditions in the same establishment.

When Can You Expect To Receive Results of the Pay Rate Review?   The College will provide results with a reasonable timeline.   Generally speaking, the results will be provided to you within 30 business days.   Please ensure you discuss your pay rate concerns with your immediate supervisor before submitting your request to the College to ensure you have the correct understanding of your assigned job responsibilities.
